THE CAKE FESTIVAL JAMAICA LIABILITY WAIVER, RELEASE AND INDEMNITY AGREEMENT

I hereby waive and release any rights, actions, or claims against Cake Festival JA for any liabilities and damages, including but not limited to food-borne illnesses, allergic reactions, and death, arising out of the consumption of food or beverages provided or purchased at the event.

By purchasing a ticket, entering the event premises, or participating as an attendee, vendor, or volunteer at The Cake Festival (Cake Picnic JA), I explicitly agree to the following terms and conditions:

1. Assumption of Risk
I understand that attending a public food and entertainment festival involves inherent risks, including but not limited to food consumption (allergic reactions, foodborne illness), slips, trips, falls, and contact with other attendees or equipment. I voluntarily, knowingly, and freely assume all risks, both known and unknown, associated with my participation in this event.

2. Release of Liability
I hereby release, waive, and forever discharge the event organizers of Cake Festival JA, its parent companies, affiliates, directors, officers, employees, volunteers, and the venue management (The Emancipation Park Board of Trustees and the National Housing Trust), from any and all claims, demands, actions, liabilities, or financial responsibility for personal injury, illness, death, or property damage/loss sustained during or as a result of the event, whether caused by negligence or otherwise.

3. Indemnification
I agree to indemnify, defend, and hold harmless both Cake Festival JA and Emancipation Park from any claims, lawsuits, demands, or losses (including reasonable legal fees) arising out of my behavior, actions, or any products, goods, or food items I bring, sell, or distribute at the event.

4. Media Release
I grant full permission to the organizers to use any photographs, video recordings, digital images, or audio captured of me during the event for future marketing, promotional, social media, or broadcasting purposes worldwide, without compensation or further approval.

5. Governing Law
This agreement shall be governed by, construed, and enforced in accordance with the laws of Jamaica. If any provision of this waiver is found to be unenforceable, the remaining terms shall continue in full force and effect.

Acknowledgment of Understanding
I acknowledge that I have carefully read and fully understand this Liability Waiver Agreement, appreciate the risks involved, and voluntarily agree to all of its terms.
